Terms of Service
Effective October 2, 2026. These terms govern your use of Payout Panda. By creating an account, funding a wallet, receiving a lead, or using the service, you agree to these terms for yourself and the business you represent and confirm that you have authority to do so.
1. What we deliver
We deliver exclusive California home-insurance opportunities as live transfers and callback leads. A live transfer is billable when a qualified consumer is connected to your line and your agent accepts the handoff. A callback lead is billable when we deliver the consumer's information and requested callback time to your agency.
We do not guarantee sales, quotes, policies bound, delivery volume, consumer availability at a callback time, or any return on investment. Delivery depends on consumer demand and your active profiles, filters, hours, capacity, and available wallet balance.
2. Pricing and prepaid billing
Live transfers are $50 each and callback leads are $0 each. Billing is prepaid: you fund your wallet, and each billable delivery is debited from your balance. Delivery pauses when your available balance is insufficient.
Wallet funds pay for transfer delivery only. They are not a deposit, are not interest bearing, and top-ups are non-refundable — we do not refund wallet payments back to your card. Individual transfers may be credited under our credit and refund policy, and approved credits are returned to your wallet balance. Unused balances remain available for future delivery. You authorize us and our payment processor to charge the payment method you select, including automatic top-ups you separately enable, subject to the settings shown in your account.
3. Your responsibilities
You are responsible for maintaining active licensing and appointments in the states you request, for answering transfers during the hours you set, for the conduct of your agents on our calls, and for handling consumer data lawfully after handoff. You must keep account, payment, transfer-number, and profile information accurate and protect all account credentials.
You may use delivered information only to respond to the consumer's insurance inquiry. You may not resell, redistribute, scrape, misuse, or share it with an unrelated third party; contact a consumer outside their consent; misrepresent your identity; or use the service unlawfully. You are responsible for your employees, contractors, and connected systems.
4. Call monitoring and recording consent
Calls placed, handled, or connected by Payout Panda are monitored and recorded for quality assurance, training, compliance, fraud prevention, and dispute review. By creating an account or participating in one of these calls, you give your express consent to that monitoring and recording.
You must notify every employee, contractor, and other person who uses your account or participates on your behalf that calls are recorded, and you must obtain any consent required from them. You may not disable, evade, copy, publish, or misuse recordings. Recordings belong to Payout Panda and may be retained and reviewed as described in our Privacy Policy.
Consumer contact and recording consent is handled separately. You must honor do-not-call, revocation, STOP, and other opt-out requests promptly and comply with all applicable telemarketing, call-recording, privacy, and insurance laws when making follow-up calls or sending messages.
5. Credits and disputes
Credits are governed by our Credit & Refund Policy, which is incorporated into these terms. Disputes must be submitted from your portal within the stated window. We may review relevant lead details and recordings; approved credits are returned to your wallet balance.
6. Privacy, confidential information, and connected systems
Our Privacy Policy explains how we handle personal information. Consumer information and nonpublic service information must be protected as confidential. If you connect a CRM or other third-party system, you authorize us to transmit delivered information to it and are responsible for its security, configuration, availability, and privacy practices.
7. Service availability and changes
The service is provided on an as-available basis. Telephony, email, payment, CRM, carrier, and internet services may be delayed or unavailable. We may update features, prices, qualification standards, and these terms. We will provide reasonable notice of material changes, and continued use after the effective date means you accept the updated terms.
8. Suspension and termination
There are no contracts or minimums — you may pause or close your account at any time. We may suspend delivery for non-payment, abusive conduct on calls, compliance violations, or repeated failure to answer transfers. Terms that by their nature should continue—including payment obligations, confidentiality, disclaimers, and liability limits—survive account closure.
9. Disclaimers and liability
To the fullest extent allowed by law, the service and leads are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, lead outcome, or continuous availability. Your underwriting, quoting, compliance, and sales decisions remain solely yours.
To the fullest extent allowed by law, our total liability for any claim relating to the service is limited to the amount you paid us for deliveries in the ninety days preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, punitive, or consequential damages, lost profits, lost data, or lost business. Some jurisdictions may not allow every limitation, so applicable limits apply only as far as the law permits.
10. Indemnification
You agree to defend, indemnify, and hold harmless Payout Panda and its personnel from third-party claims, losses, and reasonable costs arising from your unlawful use of the service, your handling of consumer data, your communications with consumers, your insurance activity, or your violation of these terms.
11. General terms and contact
These terms, the Privacy Policy, and the Credit & Refund Policy are the complete agreement for the service unless a signed written agreement says otherwise. If one provision is unenforceable, the others remain in effect. Failure to enforce a provision is not a waiver. You may not transfer your account or agreement without our written consent. Electronic notices and signatures are valid. Questions or legal notices may be sent to hello@payoutpanda.com.
